First Department
With respect to deadlines to file briefs in the Appellate Division: First Department, the Court has advised that, in accordance with Governor Cuomo’s Executive Order of April 7, 2020 (E.O. 202.14), respondent and reply briefs that were due for the May and June Terms should be filed no later than Friday, May 8, 2020, with any subsequent reply briefs due on Monday, May 18, 2020. If you wanted to file a respondent brief before the May 8th, you may do so. In that case, the reply brief deadline depends on when the respondent brief was filed/served. If the respondent brief has been filed by/before April 15, 2020, the reply brief will be due on May 8, 2020. If the respondent brief is not yet filed, then the respondent brief will be due by May 8, 2020 and the corresponding reply brief will be due by May 18, 2020.
Second Department
In the Appellate Division: Second Department, virtual operations are increasing. Calendars for April 27 through May 8th are now being published. All matters calendared will be either marked submitted or argued via Skype. If you would like to argue via Skype, you must email the Court in advance at ad2clerk@nycourts.gov. All filing deadlines are still tolled indefinitely.
