On March 26, 2013, the United States Supreme Court heard oral arguments in the case regarding the constitutionality of California’s Proposition 8, a 2008 ballot initiative that amended the state constitution to allow only opposite-sex couples to marry.
The case, entitled Dennis Hollingsworth v. Kristen M. Perry (formerly known as Perry v. Brown and Perry v. Schwarzenegger), presented the following issues to the Supreme Court: (1) whether the Equal Protection Clause of the Fourteenth Amendment prohibits the State of California from defining marriage as the union of a man and a woman; and (2) whether petitioners have standing under Article III, § 2 of the Constitution in this case.
The case is on appeal from the U.S. Court of Appeals for the Ninth Circuit, which held that Proposition 8 was unconstitutional.
